Terms of Use and Software Licence

Effective 21 October 2026.

These terms apply to creekx.io and to the CreekX software (the "Software"), however you obtained it: from creekx.io, from a cloud marketplace image, or from a partner. By installing or using the Software, or using creekx.io, you agree to them. If you use it for an organisation, you agree for that organisation and confirm you may do so.

1. The licence

1.1 Trial. The Software runs a free 14-day trial from its installation. During the trial you may use it to evaluate it, including with real streams.

1.2 Paid licence. To use the Software after the trial you need a licence key from us. A licence lets you install and use the Software on the number of servers, and with the number of channels, cameras and features, stated in your licence or order, for its term.

1.3 What you may not do. You may not: share, sell or publish a licence key, or use one on more servers than it allows; remove, bypass or tamper with the licence checks; resell or sublicense the Software, or offer it as a service to others, without a written agreement with us; or remove our copyright notices.

1.4 Ownership. We own the Software and keep all rights not expressly granted here. You get a licence to use it, not ownership of it.

1.5 Open-source components. The Software installs open-source programs beside it (FFmpeg, MediaMTX, PostgreSQL, Caddy, coturn, Node.js and others), each under its own licence. Those licences, not these terms, govern those programs, and nothing here limits your rights under them. They are listed, with how to get their source code, at https://creekx.io/open-source and in THIRD_PARTY.md in every release.

2. Your content and your viewers

2.1 Your content is yours. Everything you stream, record, upload or store with the Software belongs to you or to whoever gave you the right to use it. The Software runs on your server; we do not receive or host your content.

2.2 You are responsible for it. You must have the rights to what you stream and distribute, and you must use the Software lawfully. You may not use it for content that is illegal, that infringes others' rights, or that exploits or harms children.

2.3 Your viewers' data. You are responsible for the personal data your server processes (for example viewers' network addresses and chat) and for telling your viewers about it. Our privacy policy (https://creekx.io/privacy) covers only what we receive.

2.4 Platforms you stream to. When you send streams to YouTube, Twitch, Facebook or other services, their terms apply to that use.

3. Payment

Prices, terms and what each licence includes are as stated on creekx.io or in your order or invoice at the time of purchase. Fees are payable in advance and, except where the law requires otherwise or we agree in writing, are not refundable. Taxes are added where applicable.

4. Support and updates

We provide updates and support as stated for your licence. A licence that has ended keeps the version you have working for its grace period, then the Software asks for a new key.

5. Warranty

The Software and creekx.io are provided "as is". We work to make the Software reliable and to fix problems you report, but we do not promise that it will be uninterrupted or free of errors, or that it meets every purpose. You are responsible for backing up your data (the Software includes creekx backup for this) and for the servers you run it on. Where the law does not allow these exclusions, they apply only as far as the law allows.

6. Liability

To the extent the law allows, we are not liable for indirect, incidental or consequential loss, or for loss of profits, revenue, data or goodwill, and our total liability for any claim relating to the Software or creekx.io is limited to the amount you paid us for the licence in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

7. Ending

You may stop using the Software at any time. We may end your licence if you seriously break these terms and do not put it right within 30 days of our notice. When the licence ends you must stop using the Software beyond what the trial or grace period allows. Sections 1.3, 1.4, 2, 5, 6 and 8 continue after it ends.

8. General

8.1 Law and courts. These terms are governed by the laws of India. Courts in India have jurisdiction, unless the law where you live gives you the right to bring a claim there.

8.2 Export. You may not use or provide the Software in breach of export or sanctions laws.

8.3 Changes. We may update these terms; the version on creekx.io with its effective date applies from that date. Changes do not take away rights under a licence already paid for during its term.

8.4 Whole agreement. These terms, your order and any signed agreement with us are the whole agreement about the Software. If part of these terms is found unenforceable, the rest still applies.
